Mediation Confidentiality



Center For Resolutions' Policy on Confidentiality

  1. What do we hold confidential?
    The Center For Resolutions (formerly Community Dispute Settlement Programs of Delaware County (CDSP)) holds confidential all communications, written or oral, which occur prior to, during, or after mediation. This includes:
    1. discussions with disputants or their representatives
    2. information from referral sources
    3. what parties said or did during mediation sessions
    4. the content of any agreements reached
    5. case files.

  2. No advocacy, no judgments.
    Center For Resolutions arranges mediations and provides mediators. It does not advocate or pass judgment. Staff and mediators' judgments or personal opinions are not included in the parties' records, and are not conveyed to the mediation participants or any other persons or outside organizations.

  3. Protecting the privacy of the parties.
    Parties' names will only be used during the intake process and in discussions with the Center For Resolutions staff and the co-mediators. Mediators and staff will describe the dispute and the session to others in a way which does not suggest the identities of the parties.

    Mediators will destroy personal notes made during the mediation, and no notes or mediator's evaluation of session forms will be placed in the case file. Personal information recorded in case files will be minimal, and will be confidential.

  4. What Center For Resolutions tells referral sources and courts
    Center For Resolutions staff and mediators will absolutely not discuss the intake nor the mediation itself with referral sources, courts, police, management, media, or any other persons outside the Program. The referral source will be told, upon request, only
    1. whether a mediation was held and
    2. whether an agreement was reached.
